SHOW US YOUR MESS, AND YOU COULD WIN A COMPLETE HOME MAKEOVER!

ELIGIBILITY: To be considered for the Grand Prize in the "CLEAN HOUSE: Search for the Messiest Home Contest" ("Contest") you must be an English-speaking legal resident
of one of the 50 United States or the District of Columbia, who is 21 years of age or older as of December 1, 2007. This Contest is void in Puerto Rico, the U.S. Virgin Islands,
U.S. Military installations in foreign countries, all other U.S. territories and possessions, outside of the United States, and wherever else prohibited by law. This Contest is sponsored by E! Entertainment Television, Inc., ("Sponsor"). The following people are not eligible to enter the Contest:
  1. Employees, shareholders, officers, directors, agents, or representatives of Sponsor, Hothouse, Inc. ("Contest Administrator"), any entity involved in the development, production, implementation, or administration of the Contest or Style Network's "CLEAN HOUSE" show ("Show"), any other Contest sponsor that may be announced or otherwise added as a sponsor to the Contest prior to or at any time after December 1, 2007, or their respective parent companies, affiliates, subsidiaries, legal, advertising, and promotion agencies, promotion partners, and their immediate family members (i.e., spouse, mother, father, sister, brother, uncle, aunt, nephew, niece, grandparent, in-law, daughter, or son, regardless of where they live) and persons living in the same household (whether or not related); and
  2. Those who are represented under contract (e.g., by a talent agent or manager),
    who are members of any guild and/or union (including, without limitation, SAG
    or AFTRA), or who are under an acting, modeling, merchandising, or other contracts, if such contract or membership would (in Sponsor's sole discretion) limit or impair Sponsor's ability to use or reuse the Video (described below), unfettered, royalty-free, and without any union, guild, or other payments, in any media or form.
The submission period begins on December 1, 2007, at 12:01 AM Pacific Time ("PT"),
and ends on February 10, 2008 at 5:00:00 p.m. PT (the "Submission Period").
ALL ENTRIES MUST BE SUBMITTED DURING THE SUBMISSION PERIOD
. This Contest is subject to these official rules ("Official Rules"), which can be found at www.stylesearchforthemessiesthome.com/rules and also may be requested by mail, as explained in the section of these Official Rules entitled "Official Rules and Name of Winner." HOW TO ENTER: Make your own live-action video ("Video") according to the Submission Guidelines (as defined and set forth below). Your Video can be as creative as you like within the Submission Guidelines. Once you have created your Video, you may enter one of two ways:
  1. Online Method: visit www.stylesearchforthemessiesthome.com/messiestvideo.com
    ("Submission Site") and follow the on-screen instructions to upload your Video online ("Online Submission") and fill out completely and accurately the entry form, including your name, address, date of birth, phone number, e-mail address, the names and date of birth of all individuals appearing in the Video, and the names and dates of birth of all individuals who produced, videotaped, or edited the Video.  You also will need to follow the instructions at the Submission Site to review and electronically agree to these Official Rules and related representations.  Online Submissions must be received no later than February 10, 2008, at 5:00:00 PM PT, according to Sponsor's electronic time stamp. 
  2. Mail Method: Download and print out the Mail-In Entry Form at www.stylesearchforthemessiesthome.com/mail-in-entry, fill it out completely and accurately, including your name, address, date of birth, phone number, e-mail address, the names and date of birth of all individuals appearing in the Video, and the names and dates of birth of all individuals who produced, videotaped, or edited the Video, sign and date the hard copy of the Mail-In Entry Form to acknowledge your agreement these Official Rules and related representations, and send your Video in VHS, or in digital form on a CD, miniDV cassette or DVD only, accompanied by the printed and signed Mail-In Entry Form to:  Search for the Messiest Home Contest, P.O. Box 2783, Atlanta, GA 30301. The Mail-In Entry Form and Video submitted by mail are collectively referred to as the "Mail-In Submission."  Your Mail-In Submission must be postmarked no later than February 10, 2008 and received by 5:00 PM Pacific Time on February 15, 2008. No hand deliveries will be accepted. DO NOT USE FED EX OR ANY OTHER CARRIER THAT MAY NOT DELIVER TO A P.O. BOX.  Any Mail-In Submission(s) sent return receipt requested will not be accepted.  Any Mail-In Submission(s) not submitted in accordance with these Official Rules and/or Mail-In Submission(s) or that are mutilated or tampered with are void. Videos submitted by U.S. mail must be accompanied by original completed Mail-In Entry Form.  Your Mail-In Entry Form may not be sent separately from your Video.
All Online Submissions and Mail-In Submissions (collectively, "Submissions") received by the end of the Submission Period that are complete, meet the Submission Guidelines below, and otherwise meet the eligibility requirements set forth in these Official Rules will be judged in accordance with the judging criteria set forth below. Sponsor or Contest Administrator may in their sole discretion require any entrant to complete, sign, and submit additional forms to verify the information supplied in the Submission. In addition, Sponsor or Contest Administrator may in their sole discretion require any entrant to also fill out, sign, and mail in or have those people appearing in the Video or who produced, videotaped, or edited the Video fill out, sign, and mail in additional releases and other forms within the time frame specified by Sponsor or Contest Administrator to move forward in this Contest.
As a condition of entry, each entrant agrees that any Video or portion thereof
may be published, displayed, or used in any way by Sponsor in its sole discretion, including, without limitation on the internet, without any consideration, notice, review, approval or consent. As a condition of participating in the Contest, each entrant agrees to be bound by the terms and conditions of the Submission Site and Privacy Policy, located at www.stylesearchforthemessiesthome.com/terms and www.stylesearchforthemessiesthome.com/privacy.
NO SUBMISSIONS WILL BE ACKNOWLEDGED OR RETURNED AND,
IN FACT, MAY BE DESTROYED. DO NOT SUBMIT FOR CONSIDERATION ANY IRREPLACEABLE OR ONE-OF-A-KIND VIDEO SUBMISSION.
ANY SUBMISSION (OR ANY PORTION THEREOF) THAT DOES NOT CONFORM TO THE FOREGOING REQUIREMENTS WILL BE DEEMED INELIGIBLE. SUBMISSION GUIDELINES:
Online Video formats: Video files submitted online must be 100 MB or smaller and in .mov (QuickTime), .mpg (MPEG), .mp4 (MPEG-4), .asf/.wmv (Windows Media) or .avi (AVI) file format.
Mail-In Video Formats: Videos submitted by mail must be in VHS, or in digital format on a CD or DVD only.
Length and Content: Your Video may be as short as sixty (60) seconds (minimum), but no longer than five (5) minutes in length. If a Video exceeds the five (5) minute time limit, Sponsor may in its sole discretion deem the entry admissible, in which case only the first five (5) minutes will be judged. Your Video must be of a home in which you are resident and clearly must include the following: 1) a complete home tour including, if applicable, the garage, closets, bathrooms, kitchen, backyard, attic, and basement, and 2) an audible on-camera description of how your messy home has affected your life. Everyone who lives in the home must be in the Video AND MUST CLEARLY SHOW their faces. Your Video must be in English and must not contain or depict: any nudity, indecent behavior, profanities, obscenities, unacceptable clothing or adornments, commercial/corporate advertising (including, without limitation, corporate logos, brand names, slogans, political, personal and religious statements), recognizable branded products, artwork, harmful or illegal activity or substances, threatening or defamatory statements (including words or symbols that are widely considered offensive to individuals of a certain race, gender, ethnicity, religion, sexual orientation, or socioeconomic group), or any patently offensive or obscene subject matter, as determined in Sponsor's sole discretion. Videos must not in any way disparage persons or organizations associated with Sponsor or the Contest Administrator or otherwise, must not invade privacy or other rights of any person, firm, entity, and must not in any other way violate applicable federal, state, or local laws and regulations. Each Video must not contain any music, singing, playing of any musical instrument, any performance that has been broadcast, published or televised via any media now known or hereafter devised throughout the universe in perpetuity as part of a recording of a motion picture film, music performance or television program, or any other materials protected by intellectual property laws. If, in the sole discretion of Sponsor, your Video constitutes copyright infringement or otherwise violates the rights of any third party, the Video will be disqualified. Videos can be in color or black and white, but may not be enhanced with graphics or special effects. Sponsor reserves the right in its sole discretion to disqualify any entry that, in its sole discretion, refers, depicts or in any way reflects negatively upon the Sponsor, the Contest or any other person or entity or does not comply with these requirements or these Official Rules. Submissions must be suitable for presentation in a public forum, in sole determination of judges and Sponsor. If Sponsor deems that the Video submission does not comply with these Official Rules, the entry will be void.
Other requirements: Each Video submitted must be an original work of authorship and must not have been previously submitted in this or any other contest or promotion. The entrant must be the owner or a legal tenant of the property depicted in the Video. The Video may not include any individual(s) who are represented under contract (e.g., by a talent agent or manager), who are members of any guild and/or union (including, without limitation, SAG or AFTRA), or who are under an acting, modeling, merchandising or other contract, if such contract or membership would (in Sponsor's sole discretion) limit or impair Sponsor's ability to use and/or reuse the Video, unfettered, royalty-free, and without any union, guild, or other payments, in any and all media now known or hereafter devised throughout the universe in perpetuity. Entrant agrees to indemnify Releasees (as defined below) against any and all claims of infringement from any third party for any use or reuse by Releasees of the Video. Entrant must secure written and signed release(s) of all natural persons featured in the Video as requested by Sponsor.Submissions or any other material documents that are forged, altered, or incomplete documents, will not be accepted. JUDGING: Prior to judging, all Submissions will be prescreened by the Contest Administrator to ensure that the Submissions abide by these Official Rules (including the Submission Guidelines) and the Mail-In Entry Form or the Online Video Entry Agreement described above.
First Round: Beginning on or about December 1, 2007 through and including February 10, 2008 eligible Submissions will be reviewed and scored by a qualified panel of judges, according to the following criteria: Degree of Clutter (25 points), Level of Impact on Family Life (25 points), Personality of Entrant (25 points), and Overall Presentation (25 points).
Second Round: On or about February 15, 2008, the Submissions receiving a total score of ninety (90) points or more from the first round of judging, as determined in the sole discretion of Sponsor, Contest Administrator, or their designated judges, will be reviewed and scored in a second round of judging by the Sponsor's designated production judges for the Show (defined below) based on the following criteria: Degree of Clutter (25 points), Level of Impact on Family Life (25 points), Personality of Entrant (25 points), and Overall Presentation (25 points). The ten (10) Submissions receiving the highest scores in this second round will be the finalists ("Finalists"). No Finalist will move on in this Contest to the final round of judging unless the entrant and each person appearing in the Video or participating in its creation completes, signs, and submits all releases, affidavits of eligibility, and other forms required by Sponsor or Contest Administrator within their specified time frame.
Final Round: On or about February 25, 2008, the Finalists from the second round of judging who have returned all required releases, affidavits of eligibility, and other forms, as determined by Sponsor or Contact Administrator in their sole discretion, will be submitted for final judging to the Show (defined below) production judges, chosen in Sponsor's sole discretion, who will then select a Grand Prize winner based on the following criteria: Degree of Clutter (25 points), Level of Impact on Family Life (25 points), Personality of Entrant (25 points), and Overall Presentation (25 points). The entrant with the highest number of points will be the entrant selected for the Grand Prize, subject to verification. The potential winner will be announced on or about the week of February 28, 2008 Sponsor's , Contest Administrator's, and judges' decisions are final and binding.
In any round of judging, half and quarter points may be awarded. In the event of a tie, the entrant with the highest score in the Overall Presentation category will move on in this Contest; and if still tied, the highest score in the Degree of Clutter category; and if still tied, the highest score in the Level of Impact on Family Life category. If still tied, tying entries will be rescored using the original judging criteria.
Sponsor will endeavor to notify the potential winner by mail, email, and/or telephone, in Sponsor's sole discretion, on or around February 28, 2008 The potential winner will be required to respond within seventy-two (72) hours of attempted notification. Sponsor's inability to contact the potential winner or the failure of a potential winner to respond in a timely manner to the notification may result in forfeiture of the prize won; and, in such case, Sponsor may, in Sponsor's sole discretion, choose the next highest scoring Submission. The potential winner must execute and return an Affidavit of Eligibility, a Release of Liability and, where legally permissible, a Publicity Release within ten (10) calendar days following the date of the first attempted notification. In addition, additional permission and forms may be required. Failure to comply with this deadline may result in forfeiture of the prize and, in Sponsor's sole discretion, selection of an alternate winner. Rejection or return of any prize notification or Contest-related communication as undeliverable may result in disqualification and, in Sponsor's sole discretion, selection of an alternate winner. Potential winner may be required to provide Sponsor with additional signatures on required paperwork (including but not limited to separate background check authorization forms for the potential winner and each other individual depicted in the Video) and return all original signed documents in a timely manner in order to be eligible for prizes. Should any potential winner be unwilling or otherwise unable to agree to these Official Rules, or provide permissions and/or releases as required by Sponsor in its sole discretion, or otherwise cannot accept or receive a prize for any reason, the entrant with the next highest score will be chosen from the remaining entrants until an entrant who can meet all requirements is selected. By entering, entrants understand and agree that s/he and his/her Video may appear (including broadcast and public performance) in any Sponsor-related properties (including but not limited to television and Internet properties) in Sponsor's sole and absolute discretion. However, entrants understand that Sponsor is under no obligation to permit any entrant or any potential winner to appear on-air, on the internet or in any program. PRIZE: One (1) Grand Prize Winner will be selected to receive a complete home makeover of all rooms at the Grand Prize winner's primary residence depicted in his/her Video (except the garage). (Makeover Approximate Retail Value ["ARV"]: not to exceed Sixty-Five Thousand Dollars ($65,000.00) (USD) as well as cash in the amount of Thirty-Three Thousand Eight Hundred Dollars ($33,800.00) (USD) for a total combined ARV of Ninety-Eight Thousand Eight Hundred Dollars ($98,800.00) (USD)).
Condition of Accepting and Receiving Prize: The winner and his/her primary residence and the other individuals depicted in his/her Video may appear--and by entering this Contest consent to appear--in a special one-hour episode of "Clean House" ("Show"). Makeovers may include, without limitation, the following services and goods: applying new paint; installing new flooring; and the purchase and installation of new furniture, lighting, accessories (such as bedding, artwork, curtains) and custom closet systems (if permitted by local zoning laws without the necessity of obtaining a local building permit). The winner must consent to a garage sale of any home furnishings and soft goods that Sponsor deems necessary to remove from the winning residence either because such materials are neither necessary nor reasonably workable into the makeover. Proceeds from the garage sale may be used by winner at his/her discretion. Sponsor will consult with the winner regarding the makeover, but all final makeover decisions will be in Sponsor's sole discretion. Sponsor will send Sponsor's crew, including film crew, where necessary, to conduct the makeover. The winner must agree to allow Sponsor's crew to make all suggested changes. Sponsor's staff will work with the prize winner to consider owner's personal tastes and needs in developing the makeover plans. While a winner is not obligated to retain the changes made to the winner's house as part of the prize, Releasees (defined below) are not required to restore the winner's house to its original conditions or to remove any lighting, accessories or painting installed as a part of the prize package. In some cases, winner will be asked to disclose the name and contact information of the homeowner in order to complete the makeover. The winner will be asked to provide written assurance of his/her willingness to accept the makeover plan, and to provide a waiver of any liability in connection with the makeover as a condition of winning this Contest, including release of any liability relating to any damages that may occur in connection with the makeover. Prize is non-transferable and cannot be redeemed for cash, except at Sponsor's sole discretion. No prize substitution is allowed except at the sole and absolute discretion of Sponsor, who reserves the right to substitute a prize (or portion thereof) of comparable or greater retail value. Any federal, state, or local taxes and any other costs and expenses not specified herein as being awarded are the sole responsibility of the winner. As a condition of winning a prize, the winner must be available, and must ensure the availability of the other individuals in the Video and the availability of the property featured in the Video, for filming from approximately April 1, 2008 through and including May 31, 2008. The winner also may be required to engage in public appearances, photo shoots, and other Contest- or Show-related activities, without further compensation, at Sponsor's request. All aspects of the makeover may be recorded and aired by photograph, film, videotape, DVD, web-cam, satellite and/or any other method for publication or broadcast in any media, worldwide, whether now known or later developed ("Tape"). By accepting his or her prize, the winner agrees that his/her house, name, voice, performance and/or likeness may be included in the Tape, in Sponsor's sole discretion. CONDITIONS:Contest is subject to these Official Rules. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor and Contest judges, which shall be final and binding. BY ENTERING, ENTRANTS AGREE TO RELEASE SPONSOR, HOTHOUSE, INC., INCLUDING THEIR PARENTS, SUBSIDIARIES AND AFFILIATED ENTITIES TOGETHER WITH THEIR RESPECTIVE DIRECTORS, EMPLOYEES, OFFICERS, LICENSEES, LICENSORS AND AGENTS, AND RESPECTIVE ADVERTISING AND PROMOTION ENTITIES AND ANY PERSON OR ENTITY ASSOCIATED WITH THE PRODUCTION, JUDGING, OR ADMINISTRATION OF THE CONTEST (COLLECTIVELY, THE "RELEASEES") FROM ANY AND ALL LIABILITY, LOSS OR DAMAGE ARISING FROM OR IN CONNECTION WITH THIS CONTEST, INCLUDING, WITHOUT LIMITATION, THE AWARDING, RECEIPT AND/OR USE, REUSE OR MISUSE OF ANY PRIZE OR PARTICIPATION IN ANY PRIZE-RELATED ACTIVITIES (INCLUDING ANY INJURY OR HARM RESULTING FROM PARTICIPATION IN THE MAKEOVER), PARTICIPATION IN THE CONTEST OR THE SHOW. SPONSOR MAKES NO WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE, REUSE OR ENJOYMENT OF ANY PRIZE OR PORTION THEREOF, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. Releasees are not responsible and/or liable for: any lost, late, incomplete, inaccurate, delayed, illegible, mutilated, misdirected or postage-due Submissions or mail; any error, omission, interruption, defect or delay in transmission or communication; technical or mechanical malfunctions; interrupted or unavailable cable or satellite systems; errors, typos, or misprints in these Official Rules, in any Contest-related advertisements or other materials; failures of electronic equipment, computer hardware, or software; lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled, or delayed electronic communications or entry information, whether caused by Sponsor, the user or by any of the equipment or programming associated with or utilized in this Contest or by any human error or for any other error of any kind relating to or in connection with the Contest whether network, computer, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors which may occur in connection with the administration of the Contest or the processing or judging of Submission. Sponsor reserves the right to cancel, modify, or suspend the Contest if it is incapable of being conducted as planned or is otherwise materially affected by any circumstances, including, without limitation, natural disasters or by any other force majeure event, action, regulation, order, or request by any governmental or quasi-governmental entity, equipment failure, including overloading of a website due to excessive uploads, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other similar or dissimilar cause. In the event of a dispute concerning any person who submitted a Video online, the Video will be declared to have been submitted by the authorized account holder of the e-mail address given at time of submission, but only if that person meets all other eligibility criteria. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Potential winner may be requested to provide Sponsor with proof that he or she is the authorized account holder of the e-mail address associated with the potentially winning entry. If a dispute cannot be resolved to Sponsor's satisfaction, the entry will be deemed ineligible. Sponsor may prohibit an entrant from participating in the Contest or winning a prize if, in Sponsor's sole discretion, Sponsor determines such entrant is attempting to undermine the legitimate operation of the Contest by cheating, deception, or any other unfair playing practices or intending to annoy, abuse, threaten, undermine, or harass any other entrants, users, or Sponsor's representatives or is otherwise not in compliance with these Official Rules, and all associated Submissions will be void. CAUTION: ANY ATTEMPT BY AN INDIVIDUAL OR ANY OTHER PERSON TO DAMAGE OR UNDERMINE THE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK CIVIL AND/OR CRIMINAL PROSECUTION AND/OR DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules. By entering the Contest, each entrant hereby agrees to submit generally and unconditionally to the personal and exclusive jurisdiction and venue of a court of competent jurisdiction located in Los Angeles, California.
By entering, except where prohibited by law, each entrant grants to Sponsor, Sponsor's promotional partners, and third party marketing entities the right to use the entrant's name, likeness, persona, photographs, voices, biographical and other information, performance and Submission (including, without limitation, the Video and Tape), without notice, compensation, review, or approval, in any and all media now or hereafter known throughout the world, in perpetuity, by any and all manners and methods, and for any and all purposes or programs, now known or hereafter devised, including but not limited to broadcast television, non-broadcast television, pay, cable and network television, satellite and closed-circuit transmission, in-flight video, home entertainment (including home video, DVD, CD-ROM in current and future formats, and online services, both commercial and inter networks), wireless, podcasting, Internet, linear, digital and interactive formats, and printed transcripts, and to advertise and promote Sponsor, the Contest, and for any other purpose in Sponsor's sole and absolute discretion. Each entrant further acknowledges and agrees that Sponsor shall have full right and power to edit, translate, dub or alter, separate, mix, combine with other material, reuse and adapt any or all portions or elements of the Video and/or Tape in any way and for any purpose whatsoever, at any time, now or in the future, in any media now known or hereafter devised throughout the world in perpetuity and for any purpose in Sponsor's sole and absolute discretion.
Sponsor reserves the right to use or reuse the Submissions and/or Tapes for publicity purposes prior to, during, or after the Contest end date, in any media, and to use the names, likenesses, performances and/or hometown names, of any Contest entrants and/or participants, including all or part of their Submissions throughout the world, in perpetuity, without any compensation or prior review unless specifically prohibited by law. Taxes, if any, are the sole responsibility of the selected winner, and the selected winner may be issued an IRS Form 1099 for the ARV of any awarded prize. Sponsor reserves the right to disqualify any entrant that Sponsor finds to be tampering with the entry process or the operation of the Contest or violating these Official Rules. PRIVACY: All personal information collected by Sponsor will be used for administration of the Contest and in accordance with Sponsor's privacy policy. Entrants may be sent promotional material related to Sponsor's other entertainment options. Any questions regarding privacy matters should be directed to the address set forth below.
